Dynobond, Canada ETAL. Sued for patent / trademark infringement. Other
manufacturers, users and purchasers may be in violation.
TME Enterprises/Omni Building Products under rights of assignment has filed suit for infringement on its U.S. and other patents that protect Flexblock, Dynoblock and Dynobond, the company’s cement block systems and polymer cement additive. Suit was filed against Dynobond, Canada and over 20 companies and individuals, and importantly, any manufacturers, suppliers or contractors offering products that contain Dynobond, Flexblock, Dynoblock are also infringing on these patents.
The suit asserts that without TME Enterprises/Omni Building Products' consent, Dynobond, Canada et al is making, using, selling and/or offering for sale products that fall within the scope of at least one claim of each of TME Enterprises/Omni Building Products' three patents. The suit, filed with the U.S. District Court, Central District of California, is mainly related to U.S. Patents 4,923,855 (issued 5/8/90), 4,954,492 (issued 9/4/90), and 5,194,615 (issued 3/16/93), Canadian Patent 2,059,941 (issued 2/4/03) as well as a number of other international patents.
The suit seeks an injunction against continued patent infringement and violation of TME Enterprises/Omni Building Products' trademark rights. It also seeks an accounting of Dynobond, Canada et al profits that have resulted from the infringement and award of damages as a result of the company’s willful and deliberate patent infringement.
